摘要:就业性别歧视是一个世界性难题,在不同国家或地区不同程度地存在着,但遗憾的是,它没有引起我国法学界的广泛关注和足够重视。在我国,法律关于性别歧视的规定还存在着一定的漏洞和不足,如法律适用范围狭窄,缺乏明确反就业性别歧视机构,法律缺乏可操作性,以及司法救济途径不完善等。因此笔者针对我国就业性别歧视的存在的法律问题进行初步分析,并在此基础上,借鉴国外相关立法经验,立足我国国情,提出了反就业性别歧视的法律对策,以加快构建和完善我国反就业性别歧视的立法。

Abstract:Gender discrimination in employment is a worldwide problem, in different countries or regions exist in varying degrees, but unfortunately, it did not cause widespread concern in our jurisprudence and adequate attention. In China, the provisions of the law on sex discrimination also exist some loopholes and deficiencies, lack of a clear anti-sex discrimination in employment agencies such as the legal scope of application is narrow, legal lack of operability, as well as judicial remedies imperfect. So I conduct a preliminary analysis of the existence of laws against sex discrimination in employment, and on this basis, foreign legislative experience, based on China's national conditions, anti-sex discrimination in employment law measures to speed up the build and improve China's anti-employment sex discrimination legislation.

我国目前的立法不足以充分的保障劳动者平等的就业权,这造成了极大的社会危害。因此,从理论上充分研究和探讨就业性别歧视问题,进而为我国平等的就业提供合理的参考和建议就是一件非常重要和迫在眉睫的事。我国可以通过法律制度与社会保障的不断完善,完善我国相关劳动法律法规,必将实现从就业领域到整个社会领域的男女平等,最终实现社会的和谐发展。另外,可以借鉴国外女性就业的有益实践,比如建设专门的就业性别歧视机构;明确法律责任等,通过国家立法和各方面配套制度的共同作用,最终合理解决我国女性平等就业问题。
