摘要:随着中国经济的突飞猛进，犯罪形式越发多样复杂，人民群众对法律规范的要求越来高，我国立法完善进度必须加快。“激情犯罪”是被多数国家所重视的一个减轻量刑的犯罪情节，其中多数法制发展较健全的西方国家对“激情犯罪”有明朗的研究成果并较好的运用在实际司法审判活动中，然而我国对“激情犯罪”的相关法律规定存在明显不足，在刑法上对“激情犯罪”进行立法完善具有必要性。只有充分认识“激情犯罪”的含义，深入研究法治健全的西方国家对“激情犯罪”的立法及司法实践，并全面考虑我国的实际情况，才能真正完善“激情犯罪”的法律规范。

Abstract:With the rapid development of China's economy, the more varied and complex forms of crime, the people have became harder to satisfy demands of the legal standard, China's legislation progress must speed up. "Passion crime" is most paid great attention by a reduce sentencing the circumstances of the crime, most western countries which of the legal system development perfect and the "passion crime" has clear research results and good use in actual judicial activities, but our country to "passion crime" of the relevant law exists obvious deficiency, in criminal law on "passion crime" legislation perfect is necessary. Only fully understanding the meaning of the "passion crime", the in-depth study of the rule by law and the "passion crime" legislation and judicial practice in western countries, and comprehensively considering the actual situation in our country, we can really improve "passion crime" laws.

　　　由于激情犯罪中行为人主观心理的特殊性、多变性和难以控制性，在立法上很难界定准确的标准来概括所有的激情犯罪。但是在对激情犯罪是否成立进行评价时，可以通过分析行为人犯罪动机形成的时间点来界定激情诱因的实质性影响，进而对行为人的具体实行行为是否成立激情犯罪进行判断。另外，在立法之外对激情犯罪辅之以司法解释的指导作用，必将有利于全面界定和科学处罚激情犯罪。
