摘 要:据有关部门统计，2012上半年北京市各级法院受理民间借贷类案件近3000件，且下半年仍有上升的趋势。

　　　相对于传统民间借贷而言，当下的民间资本借贷在主体、用途、法律关系复杂性等方面发生了巨大的变化。传统民间借贷的当事人之间往往具有特殊的人身关系，比如说亲戚、朋友、同学等，而民间资本借贷关系中往往会有担保人，有的甚至担保公司或地下钱庄就参与其中。传统民间借贷在用途上往往具有救急的功能，比如说购房、升学、治病等；民间资本借贷，具有极大的资本性质，当事人都以盈利为目的，借贷人借贷用于投资，出借人往往以获得高额的利息为目的。传统民间借贷法律关系较为简单，往往都是民法中的债权债务关系，当事人往往只涉及出借人和借贷人；而民间资本借贷法律关系较为复杂，不仅有债权债务关系，商事担保关系，还涉及到国家的金融政策法规等。传统的民间借贷由于具有应急的功能，往往涉及的金额不高；而民间资本借贷由于具有投资的功能，数额至少上万，甚至几十万，上百万。

Abstract:According to statistics from related departments, 2012 courts at all levels in Beijing city in the first half of accept of folk lending case of nearly 3000, and the second half of the year is still a rising trend.

　　　Compared with the traditional folk lending, the current private capital lending has undergone tremendous changes in the subject, purpose, legal relationship of complexity. The special relationship between the human body has often between traditional folk lending parties, such as relatives, friends, classmates, and private capital lending relationships tend to have security, some even Guarantee corporation or underground banks involved. Traditional folk lending tend to have the function of emergency in use, such as purchase, education, treatment; private capital lending, with capital property greatly, the parties for the purpose of profit, the borrower borrowing for investment, lenders tend to get high interest for the purpose of. Traditional folk lending legal relationship is relatively simple, often are debt in civil law relations, the parties often involves only lenders and borrowers; and private capital lending legal relations is more complex, not only have the debtor-creditor relationship, the commercial guarantee relationship, also involves the country's financial policies and regulations etc.. Traditional folk lending with emergency function, often involves the amount is not high; while the private capital lending because of the investment function, the amount of at least tens of thousands, or even hundreds of thousands.
