摘要:农民工工资拖欠问题是影响我国全面建设小康社会和构建和谐社会的重要因素。本文从法律方面进行思考，提出了解决我国农民工工资拖欠问题的重要性，并通过对法律保障制度和农民工自身方面等存在的诸多问题进行了探究与分析，然后针对这些问题，结合我国基本国情，提出了建立和完善农民工工资权益保障的法律制度、提高农民工自主的维权意识等具体措施，从而可以更加公平、有效的解决农民工工资拖欠问题，切实保障农民工的合法权益不受侵犯。

Abstract:The issue of wage arrears for peasant workers is an important factor influencing our overall development of comparative prosperity and construction of harmonious society. Viewing from aspects of the Law, this thesis proposed the importance of tackling the issue, analyzed several issues in the system of legal safeguard and the peasantworkers themselves and other problems. To solve these issues, this thesis combining with fundamental realities of China, puts forward some concrete measures to establish and perfect the legal system to guarantee the rights of peasant workers wages, and improve peasant workers’autonomous rights awareness. Thus, the issue can be reasonably solved, and interests and legal rights of peasant workers will be well-protected.

在目前，我国农民工的生存现状并不容乐观，拖欠农民工工资的现象十分突出，这已经严重损害了农民工的合法权益，威胁到了他们的生存。如何公平、合理的解决日益复杂多样的拖欠农民工工资问题，切实保障农民工权益，己成为当下经济体制和社会体制构建正面临且必须及时解决的一个重要课题。对于这种反复出现拖欠农民工工资而又无法及时得不到解决的社会问题，治本之策，我们应该从法律方面思考和探讨该问题的主要原因，并从法律法规和制度上进一步加强对农民工工资权益的法律保障，从而解决拖欠农民工工资这一社会问题。
